Occupancy Terms & Conditions
The Guest acknowledges and agrees that these conditions apply and extend to any person (also referred to as "Guest") occupying or visiting the apartment or complex and/or using the facilities in the complex at the invitation of or with the authority of the Guest.
- All Guests booking accommodation at Castaway Cove™ Resort Noosa (the complex) must be over 18 years old, hold a valid credit card and agree to the Terms & Conditions of occupancy. Bookings made with the complex are NOT confirmed until a deposit or full tariff has been received and confirmation of the booking has been issued by the complex.
- Charges must be paid by cash, bank cheque or credit card before occupancy commences unless special prior arrangements have been made.
- Occupancy starts and finishes on the dates shown on the receipt.
- Check-in at Reception is required after the check-in time on the date of arrival at which time a Guest Registration Form must be signed by the Guest in whose name the booking has been made. The balance of any tariff owing must be paid and credit card details supplied for security.
- The Guest will be liable for payment of any charges incurred by any Guest together with all replacements and necessary costs for any damage or loss to the unit and its contents or the Body Corporate property caused by any Guest.
- The unit must not be used for any unlawful purpose.
- Guests must only park cars in the garage for the unit or in the designated visitor car parking spaces.
- Only the number of people shown on the receipt or booking confirmation may stay in the unit overnight.
- No animals or pets are to be brought onto the complex.
- The complex is to be used purely for holiday accommodation only. Noisy parties or functions with excessive numbers of non-staying visitors are not permitted.
- Smoking is not permitted inside any unit, but is allowed outside on balconies. If it is found that smoking has occurred inside the unit then all costs associated with cleansing the property to remove all traces of cigarette smoke will be charged to the Guest.
- Neither the Body Corporate, the Manager, nor the Unit Owner, is liable for any damage or loss of property which a Guest may sustain while on the complex.
- The by-laws, rules and regulations of the complex and any reasonable direction of the Manager must be complied with. The unit must be vacated if after receiving a warning, any Guest fails to comply.
- There is no refund for early departure.
- The Manager recommends the Guest purchases travel insurance to cover any unforeseen circumstances.
- The Manager may inspect the unit at any time with reasonable notice and at any time without notice if the Manager is of the opinion that there has been a breach of these conditions.
- The Manager and the unit owner are not responsible for any misdescription of the unit.
- The Guest authorises the Manager to charge any credit card for any loss, damage or monetary contribution for which any Guest is liable under this document or otherwise.
- If the occupancy ends or is terminated, the Guest must immediately vacate the apartment. The Manager is authorised to do whatever is required to enforce the eviction of any Guest and removal of Guests’ property. If a reservation is terminated and the Guest is removed from the property, the total tariff paid for the reservation will be forfeited and there will be no refund.
- Prior to departure the unit must be left clean and tidy with all rubbish removed and placed it in the appropriate bins. Any left over food items may be left with Reception. The dishwasher must be clean or left running. The unit must be left secure with all windows and doors closed and locked. All furniture must be placed back in original positions. All keys must be returned to Reception.
- For security reasons, lost keys or remote controls will be replaced at the Guest's expense and may incur an additional cost to re-key the locks of the unit.
- The Manager is not responsible for any overbooking which may accidentally occur. In such circumstances the Manager will make every attempt to find alternative accommodation of an equivalent standard in the local area, otherwise the Guest will be entitled to a full refund for the period that the Guest was unable to be accommodated.
- No responsibility is taken by the complex for bookings made through third parties.
- All equipment or appliances in the unit or on the complex are subject to breakdown and sometimes delayed repairs. Whilst every endeavour is made by the Manager, the Unit Owner and the Body Corporate to ensure that the unit and the complex are maintained in a satisfactory condition, and whilst any breakdown of equipment, services or appliances brought to the Manager's attention will be attended to as promptly as humanly possible, the Manager, Unit Owner or Body Corporate will not be responsible for any delays in rectifying such issues due to the need to engage external tradesman, contractors or suppliers, particularly on weekends or public holidays, delays in sourcing replacement items or parts, nor due to factors beyond their control such as the weather. No refund or reduction in tariff will be made for non-availability of any of these items during the Guests' stay.
- We are members of Guests Behaving Badly Pty Limited. It is a condition of your stay with us that we may disclose information about your use of and behavior at this facility to Guests Behaving Badly Pty Limited and to third party service providers, for example those that investigate or protect against activities harmful to guests, visitors, employees and others, or to property. Once again, we can only use your personal information in accordance with our Privacy Act Statement. Castaway Cove™ Resort aims to provide its Guests with a peaceful and relaxing stay. Consequently unruly and excessively loud behaviour will not be tolerated. The management encourages Guests to report unacceptable behaviour, especially excessive noise after 10:00 pm, as soon as possible, so that the situation can be immediately addressed
